Definitions
“The website” – The Askerne Winery Online Wine Sales website for New Zealand only.
Customer” – Any person or entity who orders products online from the Askerne Winery website.
“Product” or “Products” – Products offered on the Askerne Winery website.
“Force majeure” – Fire, unforeseeable accident, act of God, natural disaster, any law/order/proclamation/
Application of Terms and Conditions
These terms and conditions apply to any contract between Askerne Winery and the customer in which the customer purchases a Wine product(s) online. Askerne Winery may vary these terms and conditions at any time without notice.
Licensing/Sale of Liquor Act
Askerne Winery confirms that it is the holder of an ‘off’ licence as defined in the Sale of Liquor Act, and as such is legally authorised to promote and deliver wine product(s)for sale by mail order.
The customer confirms that they comply with all the conditions imposed in the Sale of Liquor Legislation as to fitness to purchase wine products(s) including that they, or the recipient of a gift sent through the Askerne Winery mail order are aged 18 years or over. They acknowledge that proof of age may be required to be produced on delivery.
Security
Askerne Winery will take all reasonable steps to prevent any unauthorised entry into the Askerne Winery data-base. However,they will not be liable for any loss to a customer where a third party has gained unauthorised access to a customer’s information held by Askerne Winery.
Askerne Winery will not be responsible for any loss, costs, or expenses either directly or indirectly incurred by a customer or as a result of the customer using the website. The customer uses this website and the on-line forms at the customer’s risk.
Privacy
In completing and submitting an order for Askerne Winery products, you will be providing us with your personal information. This personal information that you provide to us will be held by us in accordance with our Privacy Policy, and will be used by Askerne Winery to process your order, and to keep you informed about new products, specials and other information that may be of interest to you, through email. If the information is not provided your order may not be processed. You have rights of access to, and to request correction of, your personal information. The customer acknowledges that Askerne Winery will provide its employees and/or agents with the customer’s personal information to enable Askerne Winery to deliver products to or on behalf of the customer.
Askerne Winery shall hold customer information in accordance with the Principles of the Privacy Act and no customer information shall be disclosed to any third party other than for the purposes of delivering product without the permission of the customer.
Availability of Product
Askerne Winery’s website will show the range of products available to the customer online.
Askerne Winery reserves the right to restrict the numbers of products available to an individual customer when available quantities are limited. Askerne Winery will advise the customer of its inability to fulfil the customer’s order as soon as is reasonably possible.
Price
The price of any product ordered by the customer shall be as per the price stated on the website at the time of the customer’s order.
Askerne Winery reserves the right to vary the price of each product.
All prices are in New Zealand currency and are GST inclusive.
Payment
Askerne Winery proposes that payment may be made by credit card (VISA /MASTERCARD). When placing an order online the customer will be required to indicate their preferred credit card.
Warranties
Except as provided in the Consumer Guarantees Act 1993, no warranty, description, representation or advice given to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise are made by Askerne Winery in relation to product(s) available for purchase on the website.
Delivery policy
(Freight free within NZ for six bottles or more.
Askerne Winery will only deliver to addresses in New Zealand.
Product(s) will be delivered by courier to the customer or the delivery address specified by the customer. If Askerne Winery is unable to deliver a product(s) to the delivery address by courier the customer agrees that Askerne Winery may arrange for the product(s) to be delivered to a recognised freight collection depot or delivered by an alternate agent such as rural post. Askerne Winery will take all reasonable steps to make deliveries in the North Island within 2 working days and the South Island within 4 working days. However the customer acknowledges that Askerne Winery’s ability to deliver is dependent upon the delivery address and deliveries to rural addresses will take longer.
Delivery is deemed to have taken place once the product has been left at the delivery address. Instructions to leave wine unattended at the point of delivery is done so at the customer’s risk. Askerne Winery accepts no liability for the theft, spoiling or any other damage caused to the product when it is left at an unattended delivery address.

Refund/Return and/or Disputes Resolution policy.
You may cancel or change your order before your goods have been dispatched from the winery. You must call us on 06 8772089 or email us at sales.askerne@xtra.co.nz if you wish to do so.
Once the product(s) have been dispatched from Askerne Winery both title and risk in the product(s) shall pass to the customer.
Askerne Winery warrants that the product(s) will be delivered in good quality and condition. Where the customer is able to satisfy Askerne Winery that the delivered product(s) was not in this state at the time of delivery Askerne Winery agrees to replace the product(s) and/or refund the purchase price. The customer must notify Askerne Winery as promptly as is practicable.
